15. Governing law and dispute resolution
These Terms are governed by the laws of India. Before initiating arbitration, both parties agree to first attempt to resolve any dispute informally by contacting us using the details below; most issues can be resolved this way without needing the process below.
Any dispute, controversy or claim arising out of or relating to these Terms — including its formation, interpretation, breach or termination — shall be resolved by arbitration under the Arbitration and Conciliation Act, 1996, as amended, rather than through court litigation. The arbitration shall be conducted by a sole arbitrator appointed by mutual agreement of the parties or, failing agreement within 30 days, appointed in accordance with the Act. The seat and venue of arbitration shall be Hyderabad, Telangana, and the language of arbitration shall be English. The arbitrator's award shall be final and binding on both parties. This clause does not prevent either party from seeking urgent interim relief (such as an injunction) from a court of competent jurisdiction in Hyderabad where the Act permits it, but the substantive dispute itself is to be resolved by arbitration, not litigation.
